Criminal charges dropped against actor Kevin Spacey

The young man alleges when he was 18 in 2016, Spacey plied him with alcohol in a Nantucket bar, the Club Car, and then groped him.

In a statement on Wednesday, the Cape and Islands District Attorney's Office said the "unavailability of the complaining witness" had led them to drop the case.

Police reports said the accuser had texted and called his girlfriend on the night he met Spacey and posted video from his encounter with the actor on Snapchat.

The case began to fall apart after the alleged victim chose to stop testifying, invoking the 5th Amendment on the witness stand last week.

The fatal blow to the case happened during an evidentiary hearing as the defense was grilling the accuser about the cellphone he was using on the night he said he was assaulted.

He was supposed to turn it over to the defence, but said it was missing.

The judge then questioned how prosecutors would be able to bring Spacey to trial if the accuser continued to refuse to testify, and prosecutors told the judge they needed time to decide how to proceed.

The accusation against Spacey emerged amid a wave of other accusations near the start of the #MeToo movement and about a year before the criminal case began.

He was first publicly accused by Star Trek: Discovery actor Anthony Rapp, who said that Spacey made sexual advances to him in 1986, when Rapp was 14 years old. The actor had been facing a felony charge of indecent assault and battery in Nantucket.

The claims date back to three years ago, when the accuser says Mr Spacey bought him alcohol and groped him at a bar on the island of Nantucket, Massachusetts.

Spacey attempted to counter the rising tide of public anger by apologizing to Rapp, and publicly announcing that he was coming out and choosing "to live as a gay man".
