Despite the sad occasion, there was still a glimmer of hope for justice as the Harris County Sherriff's Office charged Larry D. Woodruffe, 24, with capital murder for the deadly shooting, according to the Associated Press.

The Harris County District Attorney's Office said it will decide later whether to pursue the death penalty against either Black or Woodruffe.

Hailey Cantrell, niece of the falsely accused Robert Cantrell, told ABC News that she and her family are still receiving threats online - even after the arrests and confessions of two other suspects in the Houston, Texas murder case.

Once Black was in custody, investigators discovered he had also been identified by an anonymous tipster as one of two suspects rumored to be involved in the shooting death of the second grader.

Investigators believe Woodruffe and Black attacked the auto Barnes was riding in because they mistakenly thought it was occupied by people they'd fought at a nightclub hours earlier. Jazmine's family had identified a white man as the shooter.

The murder charge follows the indictment of 20-year-old Eric Black Jr., the second suspect in the attack, also for capital murder.

Community leaders commended investigators for working with activists to track down the suspected killers, but said the discovery that the shooting wasn't racially motivated didn't make Barnes' killing any less tragic.
